What Pennsylvania Veterans Should Know Before Using VA Entitlement

Pennsylvania is a judicial foreclosure state, and a slow one. A lender has to prove the default in court, and before that it generally has to send an Act 91 notice that opens a window to meet with a state-approved housing counselor. That is real protection, and it is still a reason to size the payment around what your income carries.

The bigger story is income. Pennsylvania does not tax military retirement pay. It does not tax other retirement income taken after retirement age either. It does not tax active duty pay earned outside the state. For a retired veteran, that means the state income tax line on your qualifying income is effectively zero, and residual income is the number VA weighs hardest. Very few lenders run this correctly.

A retired E-8 in Pennsylvania keeps more of the pension than in almost any state in the country. If your lender is not reflecting that in residual income, they are underwriting somebody else’s file.

What Is a Pennsylvania VA Loan?

A Pennsylvania VA loan is a mortgage guaranteed by the Department of Veterans Affairs and originated by a private lender. VA guarantees a portion of the loan instead of lending the money. That guarantee is what lets a Pennsylvania retiree buy with nothing down and no monthly mortgage insurance, on credit terms a conventional lender would decline outright.

Every VA lender works from the same handbook. What separates them is how many of their own rules they stack on top. Those extra rules are overlays, and in a state with this many veterans and this little competent VA lending, they are the most common reason a file gets denied.

Full Real Estate Tax Exemption, Not a Dollar Cap

This is one of the strongest veteran property tax benefits in the country. Pennsylvania exempts a qualifying veteran from payment of all real estate taxes on the building and the land it sits on, as the principal dwelling. Not a fixed exemption amount. Not a percentage. The whole bill.

Who Qualifies

An honorably discharged veteran with wartime or qualifying armed-conflict service, and a 100 percent permanent service-connected disability. Total disability based on individual unemployability also qualifies, as does service-connected blindness, paraplegia, or loss of two or more limbs.

There Is a Financial Need Test, and It Is Not a Cliff

This is the part almost every website gets wrong. Applicants with annual income of $114,637 or less are given a presumption of need. Above that figure you are not disqualified. You can still qualify by documenting that allowable monthly expenses exceed monthly household income. If someone told you that you earn too much, they read half the rule.

It Is Decided by the State Veterans’ Commission

You apply through your County Director of Veterans Affairs, and the State Veterans’ Commission makes the need determination. Not VA, not your county assessor alone, and not your lender.

Unmarried Surviving Spouse Can Qualify

The exemption extends to the unmarried surviving spouse on the veteran’s death, subject to the same need determination. Remarriage ends it.

What It Does to Your Payment

In a high-millage Pennsylvania school district, property taxes are frequently the largest single line in the monthly payment after principal and interest. Homestead and Farmstead Exclusion

Exempt Entirely

Veterans receiving VA disability compensation at any rating, veterans entitled to compensation who take retirement pay instead, surviving spouses receiving DIC, and Purple Heart recipients on active duty. It shows on your COE and we verify before you pay anything.

If your disability rating was granted after you closed a prior VA loan and you already paid a funding fee, you may be owed a refund. We check for it as a matter of course. Most lenders never look.

Seller Concessions: The 4% Rule Almost Everyone Gets Wrong

This is the most misunderstood rule in VA lending. Most buyers, and plenty of agents and loan officers, think the seller is capped at 4 percent. That is wrong.

The 4 percent is not the seller’s limit. It is the limit on one specific bucket. The other bucket has no VA cap at all.

Bucket 1: Your Closing Costs, No VA Cap

The seller can pay all of your normal allowable closing costs. Origination, appraisal, title, recording, credit report, prepaid taxes and insurance at customary levels. No VA percentage ceiling. Market-rate discount points for a permanent rate buydown also sit here, uncapped.

Bucket 2: Concessions, Capped at 4%

Anything of value beyond normal closing costs is a concession, capped at 4 percent of the VA reasonable value. It stacks on top of Bucket 1 rather than replacing it.

Paying Off Your Debt

The seller can retire your credit cards, collections, or an auto loan as a concession. Dropping a high monthly payment lowers your debt-to-income ratio and can turn a denial into an approval on the same contract at the same price.

Paying Your Lease Break So You Can Buy Now

An early lease termination penalty on a rental or on-post housing is an allowable concession. It is how a family stops paying rent and closes this month instead of waiting for a lease to run out. We have structured this many times.

Prepaying Your Mortgage Payments

A seller can prepay mortgage payments on your behalf as a concession. When a seller would rather not cut the price, this is often an easier yes, and it does more for your file.

The Funding Fee and a 2-1 Buydown

Both count toward the 4 percent and both are commonly seller-funded. A concession package is often easier to win than a price cut, and it does more for your approval than the price cut would.

Why that number rarely matters here

Pennsylvania home prices sit well below the baseline in most of the state, so the limit is academic for most buyers. It only comes into play when you already have a VA loan open somewhere and we are computing remaining entitlement.

If a lender calls your loan a VA jumbo

Ask which VA rule they are citing. With full entitlement there is not one. Score minimums, reserve requirements, and down payments on larger loans are investor overlays, not VA policy.

Harrisburg and the Capital Region

Dauphin, Cumberland, York, and Lebanon counties. Carlisle, Mechanicsburg, Camp Hill, Hershey, and Annville. Carlisle Barracks and Fort Indiantown Gap sit here, and this is the strongest steady VA market in central Pennsylvania.

South Central and the Cumberland Valley

Chambersburg, Shippensburg, Greencastle, and Waynesboro. Letterkenny anchors Franklin County. Affordable, and a zero-down VA loan goes a long way.

The Poconos and Northeast

Monroe, Lackawanna, Luzerne, and Pike counties. Tobyhanna, Stroudsburg, East Stroudsburg, Scranton, and Wilkes-Barre. A large retired veteran population and a lot of buyers relocating out of New York and New Jersey.

Lehigh Valley

Allentown, Bethlehem, Easton, and Whitehall. Steady growth, reasonable prices, and a deep post-service population.

Erie and the Northwest

Erie, Meadville, and Warren. Among the most affordable serious markets in the state.

How a Pennsylvania VA Loan Works

Single family, VA-approved condo, townhome, PUD, manufactured on a permanent foundation, and two to four units if you occupy one.

Common Pennsylvania VA Scenarios We Handle

You retired here and your income changed

Retirement pay, VA disability compensation, and part-time work qualify differently than salary. Disability compensation is not taxable so it gets grossed up, and Pennsylvania does not tax the pension at all. Both get missed constantly.

You are relocating out of New York or New Jersey

Very common in the Poconos and the Lehigh Valley. The tax math changes in your favor the moment you establish Pennsylvania residency, and it changes your qualifying income.

Your rating just hit 100 percent or unemployable

That can eliminate your funding fee, trigger a refund on a fee you already paid, and qualify you for a full real estate tax exemption. Three separate savings from one rating decision.

You were told your income was too high for the exemption

You already used entitlement in another state
