Learn what Delaware’s disabled veteran school tax credit really covers, when it starts, how the realty transfer tax splits, and how we approve VA files near Dover and statewide.

Delaware’s biggest tax break for disabled veterans is real, but it is a school tax credit with a three-year clock. Most pages get both parts wrong.

A Delaware VA loan is a home loan guaranteed by the U.S. Department of Veterans Affairs that lets an eligible veteran or service member buy with $0 down when they have full entitlement, with no monthly mortgage insurance and no VA minimum credit score. Delaware VA Loans: The Short Answer

The short version for Delaware: $0 down with full entitlement, no monthly mortgage insurance, and no credit score floor from VA. Residual income, not a score, is what carries a VA approval. We do not stack extra lender rules on top.

As of Q3 2026 (September 2026): VA’s chart for the money left over each month after your bills (VA calls this residual income) is $1,003 a month for a family of four in the South on loans of $80,000 or more (VA Pamphlet 26-7, Ch. 4). VA uses 41% as a check point, not a limit, for how much of your monthly income goes to debt payments (your debt-to-income ratio). Above 41%, we take a closer look at your file. That step is not needed if your money left over is at least 20% above the chart. If it is not, your loan can still be approved when a supervisor signs a note that lists the strengths in your file. VA has no minimum credit score (VA Pamphlet 26-7, Ch. 4; 38 CFR 36.4340). The 2026 county loan limit is $832,750 in every Delaware county. Full entitlement (your full VA home loan benefit) removes the VA loan limit (VA.gov loan limits; FHFA 2026 limits). Funding fee (a one-time VA fee) on first use: 2.15% with less than 5% down. After first use, with less than 5% down: 3.3%. On an IRRRL (VA’s refinance to lower your rate): 0.5%. With VA disability compensation: $0 (VA.gov funding fee table, effective April 7, 2023).

What Is a Delaware VA Loan?

A Delaware VA loan is a mortgage guaranteed by the U.S. Department of Veterans Affairs and made by a private lender. Because VA guarantees part of the loan, the lender can approve it with no down payment on full entitlement and no monthly mortgage insurance. It is the same federal program in every state. What changes in Delaware are the state’s tax rules, its insurance market, its county loan limits, and how closings work here, which is what the rest of this page covers.

Delaware VA Loan Rules and Veteran Tax Benefits

Delaware gives a property tax credit to veterans with a 100% service-connected, permanent and total disability. It lives in 14 Del. C. § 1917(d), in the chapter on local school taxes. Here is where most explanations go wrong. They call it a full property tax exemption. It is a credit for the full amount of the school tax on your home. County and city taxes are separate, so you may still get a bill.

The three-year rule is the part that catches people. A veteran who PCSes to Dover or retires into Sussex County from another state does not get the credit in year one. Plan your budget for the full school tax until you meet the domicile test and file on time.

One point we have to make clear. The credit’s rules are Delaware rules for a tax benefit only. They do not decide VA home loan eligibility. For the loan, VA needs service that is other than dishonorable and a Certificate of Eligibility. Our VA loans FAQ shows how to get your COE.

Why it matters to your approval. We qualify you on the full payment, with taxes in escrow. When the credit is on your bill, the tax line drops. That leaves more room in your debt-to-income ratio and more residual income. Before then, we use the tax you will actually pay. Delaware sits in VA’s South region for residual income.

Retirees should also know Delaware’s general pension exclusion. Per the Division of Revenue, filers 60 or older can exclude up to $12,500 of pension and eligible retirement income, and filers under 60 up to $2,000.

Why Delaware VA Files Land Here

A Delaware VA file usually comes to us after a no somewhere else. Most of the time the no came from a lender rule, not VA. We underwrite to VA Pamphlet 26-7 and 38 CFR only, and we manually underwrite files the software will not approve.

The wait before you can refinance is a VA rule too. It covers a VA IRRRL (a refinance to a lower rate) and a VA cash-out that pays off a VA loan. VA loans are also sold into bonds backed by Ginnie Mae. For loans in those bonds, Ginnie Mae adds its own wait (Ginnie Mae MBS Guide, Ch. 24). There is no monthly mortgage insurance on a VA loan. The trade is a one-time funding fee, which you can roll into the loan.

Seller Concessions and Closing Costs on a VA Loan

A Delaware seller can pay your ordinary closing costs in full, and can add concessions of up to 4% of the reasonable value on top (VA Pamphlet 26-7, Ch. 8). Concessions can clear a buyer’s debts at closing, which is often the cheapest way to fix a tight ratio.

Delaware VA Markets: Dover AFB, New Castle County, and Sussex

Dover Air Force Base and Kent County

Dover AFB sits just southeast of the city of Dover. Most airmen and families look at Dover, Camden, Wyoming, Magnolia, and Felton, with Smyrna to the north and Milford to the south along Route 1 and US-13. Expect a mix of older ranch homes, newer subdivisions, and townhomes. Many airmen stay three or four years, then rent the home out after they PCS, so homes close to the base gate and Route 1 tend to rent well. Dover is also the state capital, so state jobs keep demand steady. Kent County is at the 2026 FHFA baseline limit of $832,750, per FHFA’s 2026 county list.

Wilmington, Newark, and Middletown

New Castle County holds most of the state’s people. The 166th Airlift Wing flies from New Castle Air National Guard Base near Wilmington, and the Wilmington VA Medical Center serves veterans in the north. Middletown and the area south of the canal have newer builds with HOAs. Newark has older neighborhoods and student rentals. Some buyers here work across the line in Pennsylvania or Maryland. The county is at $832,750.

Sussex County and the beaches

Sussex County draws retirees. Lewes, Milton, and Millsboro offer newer 55-plus and HOA communities. Georgetown, Seaford, and Laurel cost less and have more rural lots. The beach towns cost the most, and many homes there are second homes or rentals. A VA loan only works if you will live in the home. Sussex is also at $832,750, even though beach prices can run well above it.

What the single limit means

All three counties share the same 2026 limit. With full entitlement, VA has no loan limit. The $832,750 figure only sets your $0 down ceiling when part of your entitlement is still tied up in another VA loan.

Who Qualifies for a Delaware VA Loan

Where Delaware VA Buyers Lose Money

The realty transfer tax. This is Delaware’s big closing cost. Under 30 Del. C. ch. 54, the state rate is 2.5% when the town or county has enacted its full 1.5% local share. The law splits the tax equally between buyer and seller unless the contract says otherwise. First-time buyers get a 0.5% cut on the buyer’s share, applied to the lesser of the price or $400,000. Know your half before you sign. On a $330,000 example purchase in a town with the full local share, a 4% total split evenly is $6,600 each, before any first-time buyer cut. Coastal flood and wind. Much of eastern Kent and Sussex is low and close to the bay or ocean. VA requires flood insurance when the home is in a FEMA special flood hazard area. Coastal homeowners insurance can cost more too. Get quotes before you make an offer, because both go into your escrowed monthly payment.

HOA dues and community fees. Many newer Delaware communities have HOA dues, and some 55-plus communities have more. Those dues count in your debt-to-income ratio and residual income, just like the mortgage. Read the HOA budget and ask about special assessments, since a new assessment can raise your monthly cost after closing.

Counting on the credit too soon. A buyer who expects the school tax credit in year one can come up short. We qualify on today’s tax bill, not a future one.

Delaware Property Types and VA Minimum Property Requirements

Condos and townhome communities are common in Middletown, Newark, and the beach towns. A condo needs to be in a VA-approved project. If yours is not on the list, ask us early. Approval requests take time, and a missing approval can stop a closing.

Manufactured homes are a big part of Sussex and Kent. VA can finance a manufactured home on a permanent foundation that is titled as real property with the land. A home on a rented lot in a land-lease community is a different situation. Ask us before you write an offer.

Rural Kent and Sussex homes often have wells and septic systems. VA’s minimum property requirements call for a safe water supply and a working sewage system that meet local health rules. Order testing early.

Older homes in Dover and Wilmington can have peeling paint, aging roofs, or old heating. The VA appraiser flags items that affect safety, soundness, or sanitation. The seller usually fixes them before closing.

Near the water, check the home’s elevation and whether it sits in a flood zone. Both shape the insurance cost that goes into your payment. Homes raised on pilings are common near the bay and can work if they meet VA standards.

Common Delaware VA Scenarios We Structure

PCS to Dover AFB

Example: A staff sergeant PCSing to Dover buys a $330,000 home in Camden with $0 down and full entitlement. We qualify on base pay plus BAH and check residual income against the South region table. We also ask the seller to split the transfer tax the standard way so her cash to close stays low. If her credit report shows a late payment from a deployment month, we explain it in the file instead of stopping at the score.

100% P&T veteran moving from another state

Example: A veteran rated 100% permanent and total retires to Milford from Virginia. He is exempt from the VA funding fee because he receives VA disability compensation. He will not meet Delaware’s three-year domicile test right away, so we qualify him on the full school tax. Once he qualifies, his escrow payment should drop.

Second VA loan after a PCS out and back

Example: A veteran kept a $180,000 VA loan on a home in another state and rents it out. That loan ties up $45,000 of entitlement (25%).

  • Delaware 2026 limit: $832,750 x 25% = $208,187.50
  • Remaining: $208,187.50 – $45,000 = $163,187.50
  • No-down-payment ceiling: $163,187.50 x 4 = $652,750

Example: A 166th Airlift Wing member with a civilian job in Newark qualifies on salary plus drill pay with a history. We document drill pay with LES statements. He buys in Middletown, where the HOA dues are part of the payment we qualify him on.

❌ Myth: “Delaware gives 100% disabled veterans a full property tax exemption.”

✅ Fact: Delaware gives a credit for the full school property tax on your home under 14 Del. C. § 1917(d). County and municipal taxes are separate, and you must be domiciled in Delaware for 3 consecutive years first.

❌ Myth: “I can use my VA loan for a beach house in Rehoboth.”

✅ Fact: VA loans are for the home you live in. A beach house you visit on weekends or rent out does not qualify. If you will live there full time, it can work.

❌ Myth: “My debt-to-income is over 41%, so I am out.”

✅ Fact: 41% is a check point, not a limit. Above it, your file gets a closer look. That step is skipped if your money left over each month is at least 20% above VA’s chart. If not, a supervisor can still approve the loan with a signed note listing your strengths.

❌ Myth: “There is a VA loan limit in my county.”

✅ Fact: With full entitlement there is no VA limit. The county limit only matters with partial entitlement.

Residual income is the money left each month after the house payment, taxes, insurance, debts, and a maintenance estimate. VA compares it to a table by region and family size. It is the number that decides most tough files.

Can I get a VA loan after bankruptcy?

Yes. VA generally looks for 2 years after a Chapter 7 discharge, and a Chapter 13 can work after 12 months of on-time plan payments with trustee approval. The reason and your recovery matter more than the date alone.

Does VA allow a VA loan on a condo?

Yes, if the condo project is on VA’s approved list. If it is not, the project can often be submitted for approval. We check the project before you write an offer.

Can I refinance a VA loan later?

Yes. An IRRRL is VA’s streamline refinance of an existing VA loan, and a VA cash-out refinance can pull equity or replace a non-VA loan. Both carry seasoning rules set by VA and Ginnie Mae.
