Renting near the Air Force Academy? The seller can pay your lease break fee on a VA loan. Watch the funding fee.
Breaking a lease to buy a house near the Air Force Academy is a bigger-dollar move than most. North Colorado Springs prices run higher, rents run higher, and lease fees run higher with them. On a VA loan, the seller can pay your lease break fee at closing as a concession, inside VA’s 4% cap. On a second VA loan, the funding fee can eat most of that cap. The JD.Mortgage Team is a no-overlay VA lender at PRMG. 25+ years, 3,100+ closed loans, Scotsman Guide Top Originator 2026. Lending in 49 states. New York excluded.

Can You Break a Lease Near the Air Force Academy to Buy? The Short Answer
As of Q4 2026 (October 2026): Seller concessions on a VA loan are capped at 4% of the home’s value as VA sets it (VA Pamphlet 26-7, Ch. 8). Seller concessions are extras the seller pays for you beyond normal closing costs. Paying off the buyer’s debts is one of the items VA lists as a concession (VA Pamphlet 26-7, Ch. 8). An E-5 with dependents in Colorado Springs receives $2,358 a month in BAH, the military housing allowance (DoD BAH, Colorado Springs, effective January 1, 2026). Service members with PCS (move) orders or deployment orders of 90 days or more can end a home lease early with no penalty (50 U.S.C. 3955).
Yes. Your lease sets the fee to leave early. On a VA loan, you can write that fee into your offer and have the seller pay it to your landlord at closing. It counts as a seller concession, so it has to fit inside the 4% cap along with any other concessions.
Why Academy Renters Get Stuck
Academy staff and cadre often rent in Briargate or Gleneagle when they arrive. Some have already used their VA loan at an earlier base. That changes the math.
A second VA loan with $0 down carries a higher funding fee than the first. If the seller pays that fee, it can crowd your lease payoff right out of the 4%. For the full rulebook, read our main guide to breaking a lease to buy a house with a VA loan.
The Seller Can Pay Your Lease Break Fee on a VA Loan
VA splits seller help into two buckets. Closing costs have no VA cap. Concessions are the extras, and they share 4% of reasonable value. VA lists paying off a buyer’s debts as a concession, and we treat your lease break fee as that kind of payoff.
- Paid at closing. The money goes straight to your landlord and shows on your Closing Disclosure.
- Never a refund. If you pay the landlord first, the seller cannot pay you back.
- Inside the 4%. The fee plus every other concession cannot go over the cap.
An Academy Example: When the 4% Runs Out
Say you are Academy cadre on your second VA loan. You find a home in Gleneagle for $600,000, and it appraises there. Your rent is $2,600, and your lease fee is two months: $5,200. Your funding fee for a second use with $0 down is 3.3% (VA funding fee table).
Seller pays both: over the cap
- 4% cap: $24,000
- Funding fee (3.3%): $19,800
- Lease break fee: $5,200
- Total: $25,000
- Over the cap by: $1,000
The fix: finance the funding fee
- 4% cap: $24,000
- Funding fee: rolled into your loan
- Lease break fee: $5,200
- Total concessions: $5,200
- Room left: $18,800
Same house, same seller money, two very different results. Rolling the funding fee into the loan keeps it out of the 4%. The seller’s money then goes to your lease payoff and prepaids, and anything left can go to closing costs, which have no VA cap.

Where Academy Buyers Move When the Lease Ends
Briargate
Established north-side homes with a short drive to the south gate.
Gleneagle and Monument
Quick access to the north gate, and a common pick for Academy families.
Flying Horse and Black Forest
Higher price points and more space. This is where full entitlement with no VA loan limit matters most.
With full entitlement, there is no VA loan limit, even above the $832,750 El Paso County conforming limit for 2026. The county limit only matters with partial entitlement, such as a VA loan still open on a home from a past base.
PCS Orders vs. No Orders at the Academy
Academy members leaving on PCS orders, or deploying for 90 days or more, can end a lease under SCRA with written notice and a copy of the orders. No early termination penalty, though rent is owed until the termination takes effect. Members staying for the rest of a tour, retirees, and civilian faculty who are veterans do not get that right. For them, the seller concession is the way out.
Our SCRA mortgage protections guide covers the full law.

Breaking a Lease Near the Air Force Academy: FAQ
Can the seller pay my lease break fee on a VA loan near the Air Force Academy?
Yes. VA counts paying off a buyer’s debts as a seller concession, and we treat the lease break fee that way. The seller pays your landlord at closing, and it counts toward the 4% of reasonable value cap.
Does the VA funding fee count toward the 4% seller concession cap?
Only if the seller pays it. A seller-paid funding fee is a concession. If you roll the funding fee into your loan instead, it does not use any of the 4%, which leaves room for your lease payoff.
What is the VA funding fee on a second VA loan?
For a subsequent use with less than 5% down, the funding fee is 3.3% of the loan. On a first use with less than 5% down, it is 2.15%. Veterans who get VA disability pay are exempt.
Is there a VA loan limit near the Air Force Academy?
No, not with full entitlement. The 2026 El Paso County conforming limit of $832,750 only matters if you have partial entitlement, such as a VA loan still open on a home from an earlier base.
Which neighborhoods are closest to the Air Force Academy?
Briargate is close to the south gate. Gleneagle and Monument are close to the north gate. Flying Horse and Black Forest are nearby at higher price points.
Can I break my lease near the Academy if I am not leaving on orders?
Yes, by following your lease’s early termination terms. SCRA only removes the penalty with PCS orders or deployment orders of 90 days or more. On a VA loan, the seller can pay the fee at closing.
